August 20,2025 Union Home Minister Amit Shah on Wednesday introduced three important bills in the Lok Sabha, proposing disqualification of the Prime Minister, Chief Ministers, and other Ministers if they remain under detention for 30 consecutive days on charges carrying a minimum punishment of five years.

The proposed legislation includes the Constitution (One Hundred and Thirtieth Amendment) Bill, 2025, the Government of Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025. Together, they seek to bring uniform rules to ensure that individuals facing serious criminal allegations cannot continue to hold top executive positions.

Explaining the intent, Shah said the initiative is designed to reinforce accountability and public trust in governance. “Those responsible for leading governments must not continue in office if they face prolonged detention under grave charges,” he noted, adding that the 30-day clause was meant to prevent arbitrary removals while addressing serious misconduct.

The opposition, however, expressed reservations. Several members argued that the provision could be misused for political purposes, as detention without conviction does not amount to guilt. Concerns were raised that the step could undermine the principle of natural justice and weaken democratic protections.

Legal observers indicated that the amendment, if passed, would significantly alter the eligibility framework for constitutional offices. It would extend to Union Territories as well, with special reference to the administrative structure of Jammu and Kashmir. Analysts also suggested that the move could open fresh debates on the balance between political accountability and the presumption of innocence.

The bills are expected to be examined by a parliamentary committee before further discussion. Heated debate is anticipated in both Houses as ruling and opposition benches prepare to contest the scope and implications of the proposed measures.

The introduction of these bills has brought renewed focus on the larger issue of probity in public life, with the government highlighting the need for clean governance while critics caution against overreach.
