Allahabad High Court Dismisses Rahul Gandhi’s Plea in Sikh Turban Remark Case

In a major judicial development, the Allahabad High Court on Friday dismissed Congress leader Rahul Gandhi’s plea challenging a Varanasi court’s decision related to his controversial remarks about the Sikh community made during a speech in the United States. The ruling paves the way for the continuation of legal proceedings against Gandhi in the MP/MLA Special Court in Varanasi.

The controversy dates back to September 2024, when Gandhi, during a public event in Virginia, remarked that “the fight in India is about whether a Sikh is going to be allowed to wear a turban” and questioned whether Sikhs would be free to wear the kara or visit the gurdwara. These remarks sparked widespread criticism, with several political and religious groups claiming they were provocative and hurtful to Sikh sentiments.

Following the statement, a Varanasi resident, Nageshwar Mishra, filed a petition seeking registration of an FIR against Gandhi. The Additional Chief Judicial Magistrate in Varanasi initially dismissed the plea in November 2024, citing lack of jurisdiction since the remarks were made abroad. Mishra subsequently appealed, and in July 2025, the MP/MLA Special Court admitted the revision petition, directing the ACJM to reconsider.

Gandhi approached the Allahabad High Court, arguing that the Varanasi court’s order was unlawful and beyond its jurisdiction. His legal team maintained that the remarks were taken out of context and did not incite violence. The High Court reserved its judgment after hearing arguments in early September.

On September 26, the High Court rejected Gandhi’s plea, allowing the Varanasi court order to stand. This decision means the case will now proceed in the MP/MLA Special Court. The Varanasi court has been instructed not to take further action until it delivers its judgment in the matter.

Legal experts note that the ruling carries broader implications for freedom of speech, the protection of religious sentiments, and the jurisdiction of Indian courts over statements made abroad. The case has already attracted nationwide attention, reflecting the sensitivity of the issue.
