The Supreme Court on Friday expressed strong disapproval of Congress leader Rahul Gandhi’s comments regarding the Indian Army and alleged Chinese occupation of Indian territory, calling his statements “unbecoming of a true Indian.” While the apex court stayed criminal defamation proceedings against Gandhi, it questioned the factual basis of his allegations, stating that public figures must act responsibly when commenting on matters of national interest.
A bench led by Justice B.R. Gavai was hearing a plea to quash defamation charges filed against the Congress MP over his past remarks suggesting that India had “surrendered land” to China during border tensions. The court emphasized that statements which may damage the morale of armed forces or mislead the public need to be backed by credible evidence, especially when made by national leaders.
“We are not stopping anyone from expressing dissent, but public figures must ensure their remarks are backed by facts and do not undermine institutions,” the bench observed.
The court’s remarks come at a politically crucial juncture. Rahul Gandhi is scheduled to host a dinner meeting of the opposition INDIA bloc on August 7, aimed at strengthening alliance unity ahead of upcoming state elections. The following day, August 8, the alliance will lead a protest march to the Election Commission, raising concerns over alleged irregularities in electoral rolls and vote rigging in the 2024 general elections.
Gandhi recently stirred controversy by echoing former U.S. President Donald Trump’s description of India as a “dead economy” and alleged that the Lok Sabha elections were manipulated. The Bharatiya Janata Party (BJP) strongly condemned his statements, accusing him of harming India’s global image and undermining democratic institutions. BJP spokespersons labelled his comments as “irresponsible” and “anti-national.”
The Congress leader’s planned protest in Bengaluru, which was to be held earlier this week, has been postponed to August 8 following the demise of former Jharkhand Chief Minister and JMM founder Shibu Soren. Party sources confirmed that the protest will now be held in coordination with other INDIA bloc leaders.
The Supreme Court’s intervention is being viewed as a reminder to political leaders about the limits of acceptable discourse in a democratic framework. While Gandhi’s supporters argue that he is raising critical issues in the national interest, critics point out that such statements could erode public trust in key institutions, including the military and the electoral process.
