The remarks came while hearing a recent case where the petitioners had made disparaging statements about judges in their pleadings. Although the Court accepted their apologies this time, it issued a stern warning that any recurrence of such conduct in the future would attract severe consequences. The bench, while accepting the apology, underscored that lawyers, as officers of the court, carry a duty to uphold decorum and ensure the sanctity of judicial proceedings.

The Supreme Court noted that the freedom to seek justice should never be misused to malign the judiciary or question its impartiality without basis. “There is a disturbing increase in instances where litigants, instead of accepting judicial orders, choose to attack the institution by making scandalous allegations,” the Court observed, adding that such practices erode public confidence in the judicial system.

In its ruling, the Court reiterated that criticism of judgments is permissible within the limits of fair comment and legal discourse. However, it drew a clear distinction between legitimate critique and defamatory allegations aimed at discrediting judges personally. The bench reminded members of the Bar that they are expected to act with restraint, dignity, and professionalism, both inside and outside the courtroom.

Legal experts have welcomed the Supreme Court’s strong stance, stating that unchecked personal attacks on judges threaten the independence of the judiciary. Senior advocates noted that while constructive criticism is vital in a democracy, unfounded accusations can have a chilling effect on judicial functioning. “The Court’s warning serves as a timely reminder that the legal profession must balance advocacy with ethical responsibility,” one senior lawyer commented.

The judgment is expected to serve as a precedent for future cases involving contemptuous remarks against the judiciary. It reinforces the Court’s earlier positions that while the right to free speech is protected under the Constitution, it does not extend to making reckless statements that compromise judicial integrity.
