Senior Congress leader Rahul Gandhi was granted bail on Tuesday by a special court in Mumbai in connection with a defamation case dating back to 2018. The case concerns comments he made during a political rally, where he allegedly referred to Union Home Minister Amit Shah using language that sparked controversy and led to legal proceedings.

The complaint, originally filed by BJP functionary Mahesh Shrishrimal, accused Gandhi of making defamatory remarks that referenced Shah’s name in the context of an old legal case. Although Shah was later acquitted by the courts in that matter, the statement made by Gandhi triggered sharp reactions from BJP leaders, prompting formal legal action.

Appearing in person at the Mumbai court, Gandhi sought bail through his legal team. His advocates argued that the statements were part of political discourse and not intended as personal defamation. The court, after considering the plea, granted regular bail and scheduled the next hearing for September 12, 2025.

This development comes amid several ongoing legal challenges faced by Gandhi, including previous defamation cases that have attracted national attention. In 2023, a conviction in another case led to his temporary disqualification from Parliament, though that decision was later stayed by a higher court.

Following Tuesday’s proceedings, Congress party officials claimed the case reflects increasing attempts to use legal tools to silence criticism from opposition voices. “Political leaders must be free to question those in power without the fear of legal intimidation,” a party representative said outside the court premises.

In response, BJP leaders reiterated their stance that public figures should be held responsible for their words, especially when allegations are made without evidence. “Legal accountability ensures that political rhetoric does not cross ethical or legal boundaries,” a spokesperson for the party remarked.

Legal analysts observing the case have highlighted growing concerns over the frequency with which criminal defamation is invoked in Indian politics. Several experts have called for revisiting the law to distinguish clearly between malicious defamation and political speech protected under democratic rights.

With the 2024 general elections approaching, the matter is likely to become part of broader political discourse. Rahul Gandhi’s bail allows him to continue his public engagements, but the legal battle remains ongoing.
